An Act of Assembly of 1753 declares pactions simoniacal whereby a minister or probationer before presentation and as a means of obtaining it bargains not to raise a process of augmentation of stipend or demand reparation or enlargement of his manse or glebe after induction.
He is supposed to mistake the poet for Boniface VIII., whose simoniacal practices, as well as those of Clement V., are again alluded to in Par.
The penalty is forfeiture by the offender of any advantage from the simoniacal transaction, of his patronage by the patron, of his benefice by the presentee; and now by the Benefices Act 1892, a person guilty of simony is guilty of an offence for which he may be proceeded against under the Clergy Discipline Act 1892.

St Peter Damian was grievously perplexed about the validity of simoniacal ordinations.
It thus presents to all vacancies caused by simoniacal presentations, or by the incumbent having been presented to a bishopric or in benefices belonging to a bishopric when the see is vacant by the bishop's death, translation or deprivation.
The simoniacal election of Pietro Mezzabarba as bishop of Florence (1068) caused serious disturbances and a long controversy with Rome, which ended in the triumph, after a trial by fire, of the mdnk Petrus Igneus, champion of the popular reform movement; this event indicates the beginnings of a popular conscience among the Florentines.
To place itself in a better posture for combating the simoniacal and concubinary prelates, the court of Rome had had to multiply exemptions and accelerate the movement which impelled the monks to make themselves independent of the bishops.
